Introduction
These terms and conditions (the “Terms”) govern the use of OMFA Healthtech Sdn. Bhd.’s ecommerce website (the “Website”) and the sale of products (the “Products”) through the Website. By using the Website or placing an order for Products, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website or order Products.
Order Process
The order process for purchasing Products through the Website consists of the following steps:
- You select the Products you wish to purchase and add them to your basket.
- You proceed to the checkout, where you provide your personal and payment details.
- You submit your order and make payment.
- We will send you an order confirmation by email.
- Product Descriptions and Availability
We take all reasonable care to ensure that all details, descriptions, and prices of Products appearing on the Website are accurate. However, we do not guarantee that the descriptions, prices, or any other content available on the Website are error-free, complete, or current.
- Order Process
Orders may be placed through the Website or by contacting OMFA Healthtech Sdn. Bhd. directly. You must provide accurate and complete information when placing an order. OMFA Healthtech Sdn. Bhd. reserves the right to cancel or modify orders that are suspected to be fraudulent or in violation of these Terms and Conditions.
- Payment
Payment for Products must be made at the time of ordering, using the payment methods made available on the Website. You are responsible for ensuring that payment is received by OMFA Healthtech Sdn. Bhd. before the order is processed and shipped.
- Order Confirmation
Upon receipt of payment, OMFA Healthtech Sdn. Bhd. will send an order confirmation to the email address provided by you. The order confirmation will include a summary of the Products ordered, the purchase price and any applicable delivery charges.
Payment
- Payment Method
OMFA Healthtech Sdn. Bhd. accepts payment by credit card, debit card, or any other payment method specified on the Website from time to time. Payment must be made in full before we can dispatch the Products to you.
- Security of Payment Information
We take all reasonable measures to protect the security of your payment information. All payment transactions are processed through secure payment gateways. We do not store or have access to your full credit card or debit card information.
- Currency
All prices displayed on the Website are in Malaysian Ringgit (RM) and all payments must be made in RM.
- Refunds
If you return Products that are defective or not as described, we will either replace the Products or refund the full purchase price, including any delivery charges, as set out in our Returns and Refunds policy. Refunds will be made to the original payment method.
- Disputes
If you have a dispute with OMFA Healthtech Sdn. Bhd. regarding a payment, you must contact us within 15 days of the payment in question. We will make all reasonable efforts to resolve the dispute in a fair and efficient manner.
Delivery
Delivery Timeframe
OMFA Healthtech Sdn. Bhd. will use all reasonable efforts to dispatch Products within the timeframes specified on the Website. However, we cannot guarantee delivery times and accept no liability for any delay in delivery.
- Delivery Address
You must provide us with a correct and complete delivery address. We are not responsible for any failure to deliver Products due to an incorrect or incomplete delivery address.
- Delivery Costs
Delivery costs will be calculated at the time of checkout and will depend on the destination and size of the order. Delivery costs are non-refundable unless the Products are defective or not as described.
- Signature on Delivery
All deliveries require a signature to confirm receipt. If you are not available to sign for the delivery, our courier may leave a card for you to arrange a convenient time for re-delivery or pickup from a local depot.
- Responsibility for Products on Delivery
Once we have delivered the Products to the address provided by you, the Products become your responsibility. You are responsible for any loss or damage to the Products from that point on.
Returns and Refunds
- Returns Policy
OMFA Healthtech Sdn. Bhd. accepts returns of Products that are defective, damaged or not as described. If you wish to return Products, you must contact us within 15 days of receipt of the Products to arrange a return.
- Refund Process
If the Products are confirmed to be defective, damaged or not as described, we will either replace the Products or refund the full purchase price, including any delivery charges, to the original payment method. Refunds will be processed within 14 days of receipt of the returned Products.
- Cost of Return
You are responsible for the cost of returning Products to us, except where the Products are defective, damaged or not as described.
- Return Authorization
Before returning any Products, you must obtain a Return Authorization from OMFA Healthtech Sdn. Bhd.. Products returned without a Return Authorization may not be accepted.
- Condition of Returned Products
Products must be returned in their original packaging, with all accessories and in a resalable condition. Products returned in a damaged or unsalable condition may not be accepted for refund.
Fraudulent or Suspicious Activity
- Definition of Fraudulent or Suspicious Activity
Fraudulent or Suspicious Activity refers to any attempt to purchase Products from OMFA Healthtech Sdn. Bhd. using false or stolen information, or any other illegal or unauthorized means.
- OMFA Healthtech Sdn. Bhd. Policy
OMFA Healthtech Sdn. Bhd. takes Fraudulent or Suspicious Activity very seriously and will take all necessary steps to prevent and report such activity to the relevant authorities. If OMFA Healthtech Sdn. Bhd. suspects that an order is the result of Fraudulent or Suspicious Activity, it may cancel the order, freeze or hold the funds and/or contact the appropriate authorities.
- Responsibility of Customer
You are responsible for ensuring that all information provided to OMFA Healthtech Sdn. Bhd. is accurate and complete, and for complying with all applicable laws and regulations.
Intellectual Property
- Intellectual Property Ownership
All Intellectual Property in the Products and the Website is owned by OMFA Healthtech Sdn. Bhd. or its licensors. You acknowledge and agree that you have no right, title or interest in or to any Intellectual Property.
- Use of Intellectual Property
You may not use any Intellectual Property for any purpose without the express written consent of OMFA Healthtech Sdn. Bhd.. You may not reproduce, modify, create derivative works, display, perform, publish, distribute, or otherwise use any Intellectual Property in any manner not expressly permitted by these Terms and Conditions.

Force Majeure
- Definition of Force Majeure
Force Majeure refers to any event or circumstances beyond the reasonable control of OMFA Healthtech Sdn. Bhd., including, but not limited to, acts of God, war, strikes, earthquakes, floods, fires, power outages, or any other event that would make it impossible for OMFA Healthtech Sdn. Bhd. to fulfill its obligations under these Terms and Conditions.
- OMFA Healthtech Sdn. Bhd. Policy
In the event of Force Majeure, OMFA Healthtech Sdn. Bhd. will use commercially reasonable efforts to minimize the impact on its customers and to fulfill its obligations as soon as practical. OMFA Healthtech Sdn. Bhd. will not be responsible for any damages, losses, or other liabilities incurred as a result of Force Majeure.

General
- These commission terms and conditions (the “Commission T&Cs”) shall apply in addition to, and comprise part of, the general OMFA Terms and Conditions as set out at OMFA Healthtech Terms & Conditions (the “OMFA T&Cs”), and any capitalised terms used herein without definition shall have the meanings assigned to them in the general OMFA T&Cs. By using our platform, you indicate that you accept these Commission T&Cs as well as the general OMFA T&Cs.
- If there is any inconsistency between: (i) these Commission T&Cs, (il) the Commission FAQs or any other brochures, marketing or promotional materials relating to commission; and (ill) the OMFA T&Cs, the following order of precedence shall be applied, but only in so far as is necessary to resolve that conflict or discrepancy:
- the OMFA T&CS;
- these Commission T&Cs;
- the Commission FAQs or any other brochures, marketing or promotional materials relating to commission.
- We reserve the right to revise these Commission T&Cs or terminate the Commission programme and any part thereof at any time. Such changes will take effect from such a date as we may determine. Further, we also reserve the right to revise the stipulated validity date of accrued commission prior to the date of termination. We will notify you of such changes via email. No additional commission will be credited after the date of termination.
- In the event that OMFA has a reasonable suspicion of fraud, an attempt at deception or in the event of the suspicion of other illegal activities in connection with redemption of commission on the platform, OMFA is entitled at its sole discretion to deduct any commission and close your account and/or require a different means of payment to recover such losses. OMFA reserves the right to commence legal proceeding.
Earning Commission
- 5% commission can be earned when making a self-purchase.
- 20% commission can be earned when your referral make a purchase.
- 10% commission can be earned when your referral’s referral make a purchase.
- 5% commission can be earned when your referral’s referral make a purchase. (up to 4 referrals down)

- 1 OMFA Point = $1
- OMFA reserves the right to change the amount of commission earned without prior written notice. Such changes will take effect from such a date as we may determine.
- Commission is calculated based on the total cart value after any offers, discounts, or promotional pricing (including but not exclusive to voucher codes) and excluding shipping charges.
Note:
Shipping charges will not be counted into earning the commission.
Use of Commission
- You may use the commission while making payment for products on the platform only, subject to the terms set out in these Commission T&Cs.
- To check the balance of commission, please visit “Account” on the platform. OMFA reserves the right to without notice deduct any commission which OMFA determines in its sole discretion has been credited into your account in error.
- OMFA assumes no liability for the loss, theft, or illegibility of commission.
- Commission is valid for the specified period stated on the commission wallet, and can be redeemed or exchange for cash.
- Commission can be used to cover partly or in full of the unit price of the Product after any offers, discounts, or promotional pricing (including but not exclusive to voucher codes).
- Commission used will not be refunded in the event the order is returned and refunded.
- Commission is not transferable between customer accounts at any time.
- Commission earned will be deducted when an order is returned and refunded.
- Please note that your available commission will be applied proportionately to the number of items in your order.
Withdrawal of Commission
- Commission is eligible for withdrawal or exchangeable for cash at any time with a minimum withdrawal of 100 OMFA Point.
- 1 OMFA Point = $1.
- The fund will be credited into your bank account within 15 working days from the date the withdrawal requestis approved.
- OMFA reserves the right to reject the withdrawal request if the request does not comply with the Commission T&C.
- OMFA reserves the right to change the minimum withdrawal limit without prior written notice. Such changes will take effect from such a date as we may determine.
Tax Liability
Members are solely responsible for any taxes owed as a result of commission earned through the referral program. OMFA does not provide tax advice and it is the member’s responsibility to consult with a tax professional if necessary.

If no “Report Abuse” link is available, please email compliance@omfa.health with specifics on the abuse, a link to the page, screenshot, and the reason you believe it violates these code. OMFA will then assign the matter to the appropriate internal investigative team for review and appropriate steps.

The reporting mechanisms listed above are for reporting suspected violations of OMFA Healthtech Sdn. Bhd.’s Code of Conduct and Business Ethics. If you suspect a violation of law, please contact law enforcement authorities.
Prohibition Against Retaliation
OMFA will not tolerate any retribution or retaliation taken against any person who has, in good faith, provided information or otherwise assisted in an investigation or proceeding regarding any questionable or allegedly unethical or illegal behavior or any behavior that goes against the provisions stated in this Code.

Bhd. a perpetual, unlimited, non-exclusive, fully sub-licensable, irrevocable, worldwide right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. Please do not share anything you do not want to share with the general public. You represent and warrant that the UGC you posted does not violate the privacy or publicity rights, copyrights, contract rights or any other rights including moral rights of any person. We will not be liable for any UGC, including, any errors or omissions, or any loss or damage incurred as the result of the use of any UGC in any manner. We are not responsible for any user’s use or misappropriation of any UGC you submit.
You understand that we may preserve UGC and may disclose UGC if required to do so by law or in good faith belief that such preservation or disclosure is reasonably necessary to comply with the legal process, enforce this Agreement, respond to claims that any UGC violates the rights of third-parties, or protect the rights, property or personal safety of us, our users and the public. You understand that the technical processing and transmission of the Site, including your UGC, may require transmitting over different networks and changes to conform to technical requirements of connecting devices or networks.

- UGC Submission Guidelines
In order to preserve the integrity of UGC content, you further represent and warrant that you will not submit any Content:
- That contains Rewards codes, offers, or advertisements
- That is known by you to be false, inaccurate or misleading
- That infringes any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy
- That violates any law, statute, ordinance or regulation
- That is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual or entity
- That contains offensive words
- That contains contact information (Email addresses, phone numbers, physical addresses, etc.)
- That contains personally identifiable information (name, social security number, birth location, etc.)
- That references a competitor’s products or services
- That encourages or supports behavior that is illegal, including violence, fraud, illegal drug use, underage drinking, or child or animal abuse
- That is critical about UGC posted on the Site or their authors
- That contains medical advice
- That collects data about other Site users
- That gains access to unauthorized areas of the Site including servers or networks
- That contains messages like “check my page”, “like my review if useful”, “click on my name”
We are not liable for any information provided on the Site with regard to recommendations on supplements for any health purposes.
We reserve the right not to post UGC or withdraw UGC for any reason and will give participants the chance to submit new content if we find the original content to not fit within our guidelines. You agree that you must evaluate, and bear all the risks that are associated with the use of any UGC, including reliance on accuracy, completeness or usefulness of such content. In this regard, you acknowledge you may not rely on any UGC. You are solely responsible for your interactions with other Site users. We, in our sole discretion, have the right but are under no obligation to monitor communications between you and other Site users and to terminate your Site access.
Continued violations of the UGC Submission guidelines can result in the participant’s account being paused or blocked. Paused accounts cannot earn, use or cash out OMFA Point. Blocked accounts cannot earn or use OMFA Point and any available balance will be voided.
You agree to indemnify us for any and all third party claims, damages, losses, liability and causes of action in any way arising from or as a result of your posting any content or materials or your failure to comply with this Agreement. You agree to cooperate as fully as reasonably required in the defense of any claim. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will still be required to indemnify us for the attorney fees and expenses in addition to any losses, claims, damages and liabilities incurred by us.

Reporting Abuse
Report Violations: If you believe that any UGC violates these guidelines or any applicable laws and regulations, please report the abuse by sending an email to legal@omfa.health. Please provide a brief description of the violation and a link to the content in question.
Confidentiality: Your report will be kept confidential and will only be used for the purpose of investigating and addressing the reported violation.
Prompt Action: OMFA Healthtech Sdn. Bhd. will review each report promptly and take appropriate action, which may include removing the offending content, blocking or banning the user, or reporting the violation to the appropriate authorities.
No Retaliation: We ask that all users refrain from engaging in any retaliation or revenge against those who report abuse, as this is a violation of these guidelines and may result in additional consequences.
